Does a Prenuptial Agreement Need to Be Notarized in Ontario?

Notarization is not the core legal requirement for enforceability. Under Ontario law, a domestic contract is generally unenforceable unless it is in writing, signed, and witnessed.
In some situations, notarization may be used as an added formality, but it is different from the statutory witnessing requirement.

What Can a Prenup Cover?

A prenup (marriage contract) can address property and support obligations and other terms related to settling the couple’s financial affairs.
It can also reference education and moral training of children, but it cannot deal with decision-making responsibility or parenting time in the same way a separation agreement might.

Can a Prenup Control What Happens to the Matrimonial Home?

A marriage contract cannot include a provision that limits a spouse’s rights under Part II of the Family Law Act (Matrimonial Home); such a provision is unenforceable.
Your agreement can still address many financial issues connected to real estate, but the matrimonial home has special legal treatment in Ontario.

Can a Prenup Decide Child Support or Parenting Arrangements?

Ontario law allows a court to disregard contract provisions about decision-making responsibility or parenting time if it is in a child’s best interests, and to disregard child support terms if they are unreasonable compared to the child support guidelines.

Can a Prenup Be Set Aside Later?

A court may set aside a domestic contract (or a clause) if:

  • a party failed to disclose significant assets or debts/liabilities, or
  • a party did not understand the nature or consequences of the contract, or
  • on other contract-law grounds
