A postnup is a marriage contract Ontario spouses sign after marriage. The agreement can address your rights and obligations under the marriage or if the marriage ends, including:

Does a Postnuptial Agreement Need to Be Notarized in Ontario?

Notarization is not the core statutory requirement for enforceability. Ontario law requires that a domestic contract be in writing, signed, and witnessed.
Notarization may be used in some situations as an added formality, but it is different from the legal requirement to be witnessed.

What Can a Postnup Cover?

A marriage contract can address property and support obligations and other terms in the settlement of spouses’ affairs.
It may refer to a child’s education and moral training, but it does not create enforceable terms about decision-making responsibility or parenting time.

Can a Postnup Control the Matrimonial Home?

Ontario law states that a provision in a marriage contract that tries to limit a spouse’s rights under the Matrimonial Home provisions is unenforceable.
Your agreement can still address many financial topics connected to real estate, but the matrimonial home has special treatment under Ontario law.

Can a Postnup Decide Child Support or Parenting Arrangements?

Ontario law allows the court to disregard domestic contract terms about decision-making responsibility or parenting time if doing so is in the child’s best interests.
The court may also disregard child support terms if they are unreasonable considering the child support guidelines and the agreement’s support provisions.

Can a Postnuptial Agreement Be Set Aside Later?

A court may set aside a domestic contract (or a provision) if:

  • a party failed to disclose significant assets or significant debts/liabilities, or
  • a party did not understand the nature or consequences, or
  • it should be set aside under general contract law
