What Are Domestic Contracts?

A domestic contract is a written agreement between spouses or partners that sets out rights and obligations related to financial matters such as property, debts, and support. To be enforceable in Ontario, the agreement must be made in writing, signed, and witnessed.

Even when properly signed, a court may set aside a domestic contract (or part of it) in specific circumstances—for example, if there was a failure to disclose significant assets or debts, if a party did not understand the nature or consequences, or on other contract-law grounds.

Domestic contracts can also include child-related clauses, but Ontario law permits courts to disregard provisions about parenting-related matters if doing so is in a child’s best interests, and to disregard child support terms if they are unreasonable compared to the child support guidelines.

Can a domestic contract decide parenting time or child support?
