What Are Wills & Estates?

Wills & Estates work usually falls into two parts: (1) planning—creating a will and powers of attorney, and (2) administration—supporting executors/estate trustees after a death.

In Ontario, these documents must be signed and witnessed correctly to reduce the risk of delays and disputes later. Planning also benefits from good organization (assets, beneficiaries, executor details, and key contacts).

Do I need a lawyer to make a will in Ontario?

A lawyer is not legally required, but proper drafting and proper execution matter. Many problems arise from unclear wording, missing information, or signing errors.

What’s the difference between a will and a power of attorney?

A will applies after death. A power of attorney is used during your lifetime if you want someone else to act for you, including if you become incapable. Ontario’s Substitute Decisions Act sets execution rules for powers of attorney, including witness requirements.

When is probate required in Ontario?

Some assets can be transferred without probate, but many banks and institutions require a Certificate of Appointment of Estate Trustee before releasing assets.

How often should I update my will?

Update when major life changes happen: marriage, separation, children, major asset changes, moving, or if an executor/beneficiary situation changes.

What should I bring to my consultation?

Bring a basic list of assets and debts, notes on who you want as executor and beneficiaries, and any existing wills or powers of attorney you have.
